Terms and Conditions for Moon's Virtual Assistant

Welcome to moonsvirtualassistant.org (the "Site"), operated by Moon's Virtual Assistant ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our Site and services. By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site.

1. Services

Moon's Virtual Assistant provides various virtual assistant services, including but not limited to administrative support, social media management, project management, VA training, and other specialized services as listed on our Site. The scope of services for each client will be defined in a separate service agreement or proposal.

2. User Obligations

• You agree to use the Site and services only for lawful purposes and in accordance with these Terms.
• You are responsible for maintaining the confidentiality of any account credentials you may have and for all activities that occur under your account.
• You agree not to use the Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site.
• You agree not to engage in any data mining, robots, or similar data gathering and extraction methods.

3. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of Moon's Virtual Assistant and its licensors. The Site is protected by copyright, trademark, and other laws of both Nigeria and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Moon's Virtual Assistant.

4. Payment Terms (for Paid Services)

• For paid services, payment terms will be outlined in your specific service agreement or during the enrollment process for training programs.
• All fees are non-refundable unless otherwise stated in a separate agreement or required by applicable law.
• We reserve the right to change our service fees at any time, provided that such changes will not affect services already agreed upon.

5. Disclaimer of Warranties

Your use of the Site and services is at your sole risk. The Site and services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

In no event shall Moon's Virtual Assistant, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Site or services.
• Any conduct or content of any third party on the Site.
• Any content obtained from the Site.
• Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Indemnification

You agree to defend, indemnify, and hold harmless Moon's Virtual Assistant and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Site, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Site.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.
